Conditions of Safety, Liability & Indemnity

No later than one week before the performance date, the performer will provide the theater with a certificate issued by an occupational health and safety service showing that the production meets the statutory safety requirements (Production RIE).
If this certificate is not in the theater's possession, the theater may cancel the performance and the performer will compensate the theater for the damage suffered by the theater (costs incurred and lost income). The theater will send an invoice for these damages, which will be paid by the performer within one month of receipt.
The parties undertake to guarantee the safety of everyone in the theatre as far as possible. In this connection, the term 'theater' shall include any loading and unloading areas as well as parking areas outside the building in which the theatre is located, insofar as these are used for work in preparation for the show.
The parties are required to work in accordance with procedures that meet the statutory requirements in accordance with the Working Conditions Act and the Working Hours and Rest Hours Act approx.
The performer sends a fully completed technical information to the theater in good time, but no later than four weeks prior to the show. On the basis of this list, the theater and performer will discuss any special safety precautions to be taken.
The performer will inform the theater in good time of any special hazards relating to the materials to be used by the performer and/or the working methods to be followed.
The theater has the right to check the materials used by the performer and his working methods at any time.
The tenant’s activities, setup, and the materials and equipment to be used must at all times comply with applicable legal (safety) requirements and fire safety regulations. These matters are subject to the judgment of the play manager or his or her substitute.
If the safety of persons and/or property is or could be endangered by the materials and/or working methods used by the performer, at the theatre's sole discretion, the theater has the right to cancel the show. In this case, all damage resulting from cancellation will be borne by the performer.
The performer indemnifies the theater from all claims by third parties as a result of a cancellation of a performance under the conditions described above.
The equipment present in the lessor's space may only be operated by the lessor's own personnel.
Access to the service areas is prohibited without supervision by one of the lessor's staff members.
On the day the production is set up, a final inspection will be conducted based on a checklist provided by the play manager.
